1. Terms and definitions
   1. Pocket-Exchange.com (the "Service") is an electronic currency exchange service providing services to Users via a special program interface located on the Internet at https://Pocket-Exchange.com/.
   2. The User is any individual who agrees to all the terms and conditions offered by the Service, and has joined this agreement.
   3. Electronic Currency Units (Title Units) are units of account of the corresponding Electronic Clearing Systems, which indicate a certain volume of rights of claim or other rights arising from the agreement between the Electronic Clearing Systems and their Users.
   4. Electronic Clearing System (payment system) - a software product created by a third party, which is a mechanism for implementing the accounting of monetary (electronic money) and/or other obligations. The main payment systems under this Agreement are: Perfect Money, Payeer, Bitcoin, Qiwi, Yandex. The exact list of the Payment Systems can be found on the website of the Service.
   5. Payment means transfer of electronic units from the payer to the recipient.
   6. Order means the information provided by the User by electronic means of the Service, indicating their intention to use the services of the Service on the conditions proposed by the Service and stated in the parameters of the Order.
   7. The User and Pocket-Exchange.com are jointly referred to as the Parties.
   8. Currency exchange means an exchange of electronic currency of one payment system for the electronic currency of the other payment system.
   9. Exchange rate - a value ratio of two electronic currencies in the course of the exchange.

   11. The Service website is https://Pocket-Exchange.com/.
2. Subject matter of the Agreement and manner of its entry into force
   1. This Agreement regulates the relations between the User and the Service, related to the services provided by the Service, and supersedes all previous agreements between the Service and the User on this subject.
   2. This Agreement does not supersede the laws and regulations effective in the countries where the User and the Service are registered or located, or the contractual relationship between the User and the Electronic Payment System(s).
   3. This Agreement is considered to be accepted under the terms of the public offer, accepted by the User while submitting the Order, which is an integral part of this Agreement.
      1. The information about the Order parameters and conditions displayed by the Service is considered a public offer.
      2. The actions aimed at submitting a Order are considered an acceptance of the public offer and the User's commitment to make a transaction through the Service on the conditions stated by the Service right before the Order is submitted. In case of registration on the website, this Agreement comes into force the moment the User checks the box in front of the words "I agree to the terms of the offer" and clicks the "Register" button.
      3. The date and time of the acceptance as well as the parameters of the Order conditions are recorded by the Service automatically at the moment the Order is submitted.
   4. This Agreement comes into force the moment the User completes the formation of the Order.
   5. This Agreement becomes ineffective at the moment the funds are sent to the account given by the User in the amount specified in the Order or at the moment of cancellation of the Order.
   6. Both the parties admit that this Agreement in electronic form is as effective as a written agreement.
   7. The Exchange reserves the right to modify this Agreement unilaterally without any notice to the User, but with the obligatory publication of the most recent version of the Agreement on this page.
3. Subject of the agreement, cost of services provided
   1. The subject of this Agreement is the services of exchanging, buying and selling the title units of electronic payment systems, carried out according to the User's order, as well as other services described on the Service's website.
   2. The amount of fees for the Pocket-Exchange.com Service for the specified actions is reflected in the Application Form and confirmed by the User on one of the pages of the user interface.
   3. The fee for the Pocket-Exchange.com Service is set by the management of the Service and published on the Internet site of the Service.
   4. The Pocket-Exchange.com Service has the right to change the exchange rates of Electronic currencies and the fees charged unilaterally at any time, and notify the Service's Users of such changes by publishing them on the Service's Internet website in advance.
   5. In the Application created by the User on the Service's website, the Exchange rate, the amount of commission charged by the respective Payment System, the Service's fee, the method of exchange, and the total amount of funds or electronic currency to be transferred should be specified.
   6. The Pocket-Exchange.com Service shall charge the value of its remuneration at the moment the respective Transaction is performed
4. Terms of Service
   1. The Pocket-Exchange.com Service can be ordered by the User by sending an Application via the Internet site of the Service.
   2. The User can manage the exchange process or receive information about the progress of the service through the corresponding user interface on the Service's website.
   3. Processing of the User's Orders is fulfilled by the Service in strict compliance with the Privacy Policy (chapter 5 of the Agreement) and with the Anti-Money Laundering and Money Laundering Prevention Policy (chapter 6 of the Agreement).
   4. Electronic Currency transactions are recorded by the Service in accordance with the regulations, rules and format of the corresponding Electronic Payment Systems.
   5. Any completed transaction conducted by the Service upon the User's Order is considered irrevocable, i.e. cannot be canceled by the User after it has been completed - the User receives the transaction amount due under the previously accepted conditions.
   6. In case the electronic units are not received from the User within one hour from the moment the User has accepted the Order, the agreement stated in the Order is considered terminated unilaterally by the Service as not entered into without any notice.
   7. In case the Agreement is terminated, the funds received after the deadline will be returned to the account of the sender within the next 24 hours. All charges and commissions for converting E-Units are paid by the User. The Service is not responsible for the possible delays in refunds if they are not caused by the fault of the Service.
   8. In case the amount of the received E-Units differs from the amount stated by the User, the Service may terminate the transaction unilaterally by canceling the transaction and returning the funds received to the account of the sender within the next 24 hours. In case of refund, all commissions for transferring the electronic units are paid by the User. The Service is not responsible for the possible delays in refunds if they are not caused by the fault of the Service.
   9. In case the funds are not sent to the account specified by the User within 24 hours from the moment the Order has been submitted, the User may request a termination of the transaction and return the account in full.
   10. Requests for cancellation must be fulfilled by the Service only if the cash equivalent of the Order has not been sent to the account indicated by the User at the time the request is received.
   11. In case of termination, the return of the Electronic Units is fulfilled by the Service to the account of the sender within 24 hours from the moment the termination request has been filed. The Service is not responsible for the possible delays in returning the units not caused by the fault of the Service.
   12. The Service has the right to use third parties to fulfill its obligations.
   13. The Service reserves the right to cancel the transaction in progress and return the Electronic Currency Units and/or financial means deposited by the User without explanations.
   14. The Service reserves the right to refuse service in case the User has violated any provision of this Agreement.
   15. In case the Service refuses to continue servicing the User, the Service notifies the User of its decision by email or phone call. Further, the Service returns the Electronic Units received through the User's Order to the details of the sender within 24 hours from the moment of refusal. When the return is made, all commission charges for the transfer of Electronic Units are made from the funds received at the User's expense. The Service is not responsible for the possible delays in refunds if they are not due to the fault of the Service.
   16. All the subsequent orders initiated by the User after the rejection of this Agreement will be automatically frozen.
   17. The Service reserves the right to delay a transaction by phone call or any other means not prohibited by the applicable law, until the identification of the User has been completed.
   18. When using the Pocket-Exchange.com Service, the User confirms that they legally own and dispose of the funds and electronic currency involved in the respective Payment.
   19. The User undertakes to independently calculate and pay all taxes required by the tax laws of the User's location.
   20. Special conditions of some Payment systems:
       - when the User sends money to the Yandex.Money payment system, the transfer is frozen for 24 hours, after this time the transfer is unfrozen.
       - when the User sends money in the Bitcoin payment system, the request for exchange will be accepted for execution after two confirmations in the Bitcoin system.
   21. The User warrants that the User is not involved in:
       - money laundering transactions;
       - receiving proceeds from drug trafficking;
       - receiving proceeds of criminal and/or terrorist activity;
       - the proceeds of trading with countries with which the trade is prohibited by international organizations;
       - proceeds from any other unlawful activity.
   22. Our exchange office provides services only to adult clients, so we cannot carry out transactions with persons under 18 years of age.
5. Privacy Policy
   1. The Service accepts the User's personal information for the transactions, which the Service undertakes to keep in encrypted form, not to disclose, not to transfer to the third parties, except for the cases stated in the paragraphs 5.4, 5.5 and 6.5 of this Agreement.
   2. All the transactions and personal data transfers between the Service and the User are secured with 256-bit SSL encryption.
   3. The Service reserves the right to collect additional information about the User, if necessary, by any available means. All the information gained from these activities is not given to the third parties, except for the cases stated in the paragraphs 5.4, 5.5 and 6.5 of this Agreement.
   4. The Exchange reserves the right to share the User's personal data and the details of their transactions, provided the details are kept confidential, upon a written request / court decision / on the User's own initiative (in case an investigation is needed), with the law enforcement authorities, as well as with the User to whom they belong.
   5. The Service reserves the right to share the details of the transaction and the User's personal data about the transaction, upon a formal request of the Electronic Currency Settlement System, for internal investigations.
   6. All the data concerning the User, as well as the details of their transactions, is to be stored in the database of the Service for three years from the moment the last Order was submitted by the User.
6. Anti-Money Laundering and Illegal Transactions Policy.
   1. In accordance with international legislation, Pocket-Exchange.com adheres to a number of rules and implements a number of procedures aimed at preventing the use of the Service for money laundering operations, i.e. actions aimed at returning money or other securities of illegal origin to the financial and economic market, representing their acquisition and possession as quite legal and normal, and conducting other operations of illegal nature.
   2. To prevent transactions of illegal origin, the Service imposes certain requirements on all the Applications created by the User:
      1. The sender and the beneficiary of a Payment Order must be the same person. Transfers in favor of third parties using the Service are strictly prohibited.
      2. All the contact details stated in the User's Order as well as any other personal data must be truthful and correct.
      3. Orders created by the User using anonymous proxy-servers or any other anonymous Internet connections are strictly prohibited.
   3. To prevent transactions of an illegal nature, the Service
      - Uses an internal system for automated analysis of transactions and User behaviour (Fraud Prevention System), which stops all suspicious transactions of the User.
      - Sets limits on the User's transactions, depending on the level of identification of the User and their country of origin.
      - Adheres to the "Know Your Customer" policy.
      - Checks all the data provided by the User by all available means.
   4. The Service reserves the right to freeze all the User's current orders until it receives from the User copies of the documents confirming their identity, the source of origin of the Electronic Units, and any other information necessary for checking the operation in the following cases:
      -When a breach of any of the requirements set out in Clause 6.2 herein is detected.
      -When the User's Order is stopped by the fraud prevention system.
      -If the administration of the Service suspects that the User is trying to use the services of the Service for money laundering or any other illegal transaction.
      In return, the User undertakes to submit the requested document within 7 working days from receiving the request to submit it, or to request the cancellation of the request.
      1. In case of the User's failure to submit the required documents, the Service reserves the right to refuse service in further, and take the actions described in the paragraph 4.10 of this Agreement.
   5. The Exchange reserves the right to refuse service in the future and take the actions described in the paragraph 4.7 of this Agreement, and afterwards, transfer all the data of the User as well as the data about the User's transactions to the law enforcement authorities in case of
      - The detection of transactions aimed at money laundering, financing terrorist organizations, fraud of any kind, as well as transactions aimed at carrying out any other unlawful or illegal operations.
      - If the Service has a reasonable suspicion that the User's submitted identification document is false or invalid.
      - The receipt of information from the authorized bodies about the unauthorized possession of the User's financial units and/or other information making it impossible for the Service to provide services to the User.
      - The detection of any actions or attempted actions of the User aimed at causing any negative impact on the hardware and software of the Service.
      - Any action or attempted action of the User aimed at theft of databases and other tangible and intangible property of the Service.
      - Any action or attempted action by the User, which may cause any physical, material or immaterial damage to the Service.
   6. The Service reserves the right to verify all the data provided by the User, employing any available means.
7. Limitation of liability
   1. The Service is not a bank. The Service offers its services 24 hours a day, seven days a week and will endeavor to ensure that the hardware and software system which enables the Service functions smoothly.
   2. The Exchange provides the Service on the "as is" basis, as described on this website, without additional warranties of any kind.
   3. By using this site, the User accepts that the liability of the Service is limited by the means received from the User for processing the required transaction; the User accepts that the Service gives no additional warranty and assumes no additional responsibility; neither does the User, except for the cases described in the paragraph 7.9.
   4. The Service makes every effort, but does not guarantee the availability of the Service's services 24 hours a day, 7 days a week. The Service assumes no responsibility for the User's losses, lost profits or any other losses incurred as a result of their inability to access the website or the services of the Service.
   5. The Exchange assumes no responsibility for any loss or damage as well as any expenses caused by delays in processing any bank transfers or electronic currency transfers.
   6. The Exchange assumes no responsibility for any damage, loss of profit or any User's expenses caused by their false expectations in respect of the fees, profitability of the transactions or any other subjective conditions.
   7. In case the User has provided incorrect information about the details of the payee, the Service does not assume any responsibility for any damages or losses caused by this mistake.
   8. By using the Service, the User assumes the responsibility to pay taxes in accordance with the tax laws and regulations of the country of their residence. The Service is not a tax agent and will not inform the User of any taxes that may be incurred through the use of the Service.
   9. The User indemnifies the Service (the management company, executives and employees) in case of any claim or demand, directly or indirectly related to the using the Service, unless it is caused by the User's faulty (intentional or careless) actions.
   10. The User must refrain from using the Service for fraudulent or illegal transactions, and agrees that any attempt of fraudulent exchange will be prosecuted to the full extent of the law. The User's actions may be considered illegal according to the law of the country where the User and/or the country where the Service is registered.
   11. The User undertakes not to tamper with the communication flows of the Service, not to interfere with its hardware and/or software, or otherwise influence in any way that may affect the normal operation of the Service, knowing that such actions will be prosecuted to the full extent of the law.
   12. In case of tampering of communication flows or any affecting of the software code of the Service, which is directly or indirectly related to the User's application, the Service suspends the application, after which the actions described in the paragraph 6.5 of the Agreement will be fulfilled.
   13. Neither the User nor the Service shall be liable for delays or inability to fulfil their obligations in case of force majeure, including natural disasters, fire, floods, terrorism, changes of government or civil unrest, as well as irregular functioning of the Electronic Payment System, power supply systems, communication networks or Internet providers.
   14. Electronic Payment Systems and/or financial institutions are solely responsible for the funds entrusted to them by the User. The Service may not be a party to the agreement between the Payment System and/or financial institution and the User, and is in no way liable for improper or unauthorized use of the Electronic Payment System features by the User, as well as for misuse of the Electronic Payment System functionality by the User. The mutual rights and duties of the User and the Electronic Payment System and/or the Financial Institution shall be governed by the respective contracts.
8. Procedure for Acceptance of Claims and Settlement of Disputes
   1. Disputes and disagreements, which may arise through the provision of services to the User, are solved by negotiations between the User and the administration of the Service, based on the provisions of this Agreement.
      1. Any claims under this Agreement may be settled by sending a message, in electronic format, with the subject of the claim to the contact information (contact page) which is available at the website of the Service.
   2. If it is impossible to solve the problem by negotiations, the dispute shall be solved by the Service, in accordance with the law at the registered office of the Service.
9. Final Provisions
   1. The Pocket-Exchange.com Service has the right to send information about the exchange process and other information, including advertising, to the User's email address.
   2. The information on the website, including graphic images, text information, program codes, etc., is the property of Pocket-Exchange.com and is protected by copyright laws. Each case of unauthorized copying (in whole or in part) may be prosecuted under applicable laws.
   3. By accepting this offer, the Payer unconditionally agrees to the processing of his/her personal data provided by the Service to the Payer for the purpose of providing services, in order to send informational and advertising messages to the Payer. The acceptance of the offer means the Payer's consent for the Service to perform operations of collecting, systematization, accumulating, storing, clarifying (updating, changing), using, distributing (including transfer to the third parties), depersonalization, blocking and destruction of their personal data, using in the processing of personal data the automated, mechanical, manual and any other way at the discretion of the Service. By accepting this offer, the Payer also agrees unconditionally that the completeness, reliability and accuracy of the information provided by the Payer may be verified by the Service, as well as provided by the Service to third parties for the purposes of such verification.
   4. This consent may be withdrawn by the Payer at any time by submitting a request to the Service to withdraw their consent to the processing of their personal data. This consent for the processing of personal data is given for the period until the Payer revokes the consent for the processing of personal data.
   5. The User confirms that they have read all the provisions of this Agreement and unconditionally accepts them, otherwise the User cannot use the Pocket-Exchange.com Service.
